City Government Smoking Regulations E-Cigarettes

Beverly Hills' Smoking Regulations Include E-Cigarettes

At the February 18, 2014 meeting, the Beverly Hills City Council voted to regulate the sales and public consumption of electronic cigarettes ('e-cigarettes') in the same manner as tobacco products in the City. E-cigarettes are nicotine delivery devices that are battery-powered and simulate tobacco smoking. The City Council felt it was important to take a proactive approach on the e-cigarette issue and promote a healthier community. The concern is the growing popularity and use of electronic cigarettes amongst the youth, according to a National Youth Tobacco Survey conducted by the U.S. Centers for Disease Control. 

The City's e-cigarette ordinance is effective as of June 1, 2014. Several other cities have recently taken measures to regulate the use and sales of e-cigarette within their communities.

The increasing popularity of e-cigarettes has prompted the FDA to consider regulating the product. In April 2014, the FDA released a set of proposed regulations, which includes the following:

  1. Prohibit e-cigarette sales to minors (those under 18 years of age)
  2. Require product labeling of health risks (known and unknown) associated with e-cigarette use
  3. Mandate FDA approval before the release of new products
